Terms of Service

You must be at least 18 years old or have legal authorization from a parent or guardian to use our Services.

Eternal Families Co. provides:

• Online memorial pages
• Obituary creation tools
• Tribute and guestbook features
• Photo and video storage
• Memorial sharing tools
• Premium memorial services
• AI-assisted Tribute songs, obituary, and memorial writing

We reserve the right to modify, suspend, or discontinue any feature at any time.

You are responsible for:

• Maintaining account security
• Keeping login credentials confidential
• Ensuring information submitted is accurate
• All activity occurring under your account

You retain ownership of all content you submit, including:

• Photos
• Videos
• Obituaries
• Stories
• Tribute messages
• Audio recordings

By uploading content, you grant Eternal Families Co. a non-exclusive license to host, display, store, and distribute the content as necessary to provide our Services.

Ownership of each Tribute Song shall be determined by the manner in which the Tribute Song is created and the rights lawfully held by Eternal Families Co.

For original Tribute Songs created, commissioned, or acquired by Eternal Families Co. with full ownership rights, all associated copyrights, master recording rights, publishing rights, intellectual property rights, and other ownership interests shall remain the sole and exclusive property of Eternal Families Co.

For Tribute Songs created using third-party technologies, artificial intelligence systems, licensed content, or other services that may be subject to separate licensing terms, Eternal Families Co. retains all rights, title, interests, licenses, and permissions that it lawfully possesses in and to such Tribute Songs.

In all cases, no ownership rights are transferred to the customer, family members, beneficiaries, or any third party. The customer receives only the limited license expressly granted under these Terms of Service.

Upon full payment, Eternal Families Co. grants the customer a perpetual, worldwide, royalty-free, non-exclusive, non-transferable license to:

• Listen to and download the Tribute Song;
• Share the Tribute Song with family members and friends;
• Play the Tribute Song at funerals, memorial services, celebrations of life, anniversaries of remembrance, and similar personal events;
• Display or embed the Tribute Song on memorial pages maintained by Eternal Families Co..;
• Share the Tribute Song on personal, non-commercial social media accounts and family websites.

The customer may not, without the prior written consent of Eternal Families Co:

• Sell, license, sublicense, distribute, assign, or transfer any rights in the Tribute Song;
• Upload, distribute, or release the Tribute Song through commercial music platforms, streaming services, digital music stores, or content distribution services, including but not limited to Spotify, Apple Music, Amazon Music, YouTube Music, TikTok Music, Pandora, SoundCloud, or similar platforms;
• Register the Tribute Song with any copyright office, performing rights organization, publishing administrator, royalty collection society, or content identification system;
• Claim authorship, ownership, copyright, publishing rights, master recording rights, neighboring rights, or royalty interests in the Tribute Song;
• Use the Tribute Song in any commercial, promotional, advertising, fundraising, business, or revenue-generating activity.

Any unauthorized commercial use, registration, distribution, or exploitation of a Tribute Song shall constitute a material breach of these Terms of Service and may result in immediate termination of the license granted herein, removal of the Tribute Song from Eternal Families Co.' services, and pursuit of all available legal and equitable remedies.

You agree that you have authority to publish memorial information regarding the deceased.

You may not:

• Create fraudulent memorials
• Impersonate family members
• Publish knowingly false information
• Publish information that violates the rights of others

Users may not post:

• Hate speech
• Harassment
• Defamation
• Threats
• Pornographic material
• Copyright-infringing content
• Malicious software
• Fraudulent fundraising campaigns

We reserve the right to remove content at our sole discretion.

If competing claims arise regarding memorial ownership, obituary accuracy, or administration rights, Eternal Families Co. may temporarily restrict access until the dispute is resolved.

We reserve the right to:

• Review tribute submissions
• Remove inappropriate comments
• Restrict guestbook access
• Disable public contributions

All fees are displayed before purchase.

Payment processing is handled by third-party payment providers such as Stripe.

We do not store full payment card information.

The Eternal Families Co. platform, branding, software, logos, and designs remain our exclusive property.

Services are provided "AS IS" without warranties of any kind.

We do not guarantee:

• Permanent availability
• Uninterrupted access
• Error-free operation

To the fullest extent permitted by law, Eternal Families Co. shall not be liable for:

• Emotional distress
• Lost data
• Memorial content disputes
• User-generated content
• Indirect or consequential damages

We may suspend or terminate accounts that violate these Terms.

These Terms shall be heard in a court of competent jurisdiction or a method of an Alternate Dispute Resolution governed by the laws of the state of the Company's choosing.

Affiliate Commission Payments

Eternal Families Co. will calculate and issue affiliate commission payments in good faith on a monthly basis. Subject to these Terms, eligible commissions earned during a calendar month will generally be paid at the end of that month, provided all applicable eligibility requirements have been satisfied.

Net Earnings

Affiliate commissions are paid solely on Net Earnings, which represent commissions remaining after deductions for refunds, chargebacks, payment processing reversals, fraudulent transactions, taxes, withheld amounts required by law, or any other applicable adjustments. Eternal Families Co. reserves the right to adjust commission calculations to accurately reflect Net Earnings.

Payment Processing Delays

Affiliate acknowledges that commission payments may be processed through third-party payment providers, banks, or other financial institutions that are outside the control of Eternal Families Co. Eternal Families Co. shall not be liable for any delay, temporary hold, processing review, transfer delay, banking issue, or other interruption caused by a third-party payment processor or financial institution.

If a payment is delayed due to circumstances beyond the reasonable control of Eternal Families Co., the Company will make commercially reasonable efforts to resolve the issue and remit any approved commission as soon as reasonably practicable after the payment restriction or delay has been lifted.

Good Faith Payments

Eternal Families Co. agrees to process and remit approved affiliate commissions in good faith and in accordance with these Terms. Nothing in this Agreement shall be construed as guaranteeing payment on a specific date where circumstances beyond the Company's reasonable control prevent timely payment.

Right to Withhold or Delay Payment

Eternal Families Co. reserves the right to withhold, delay, offset, or deny commission payments where it reasonably believes that commissions resulted from fraud, abuse, self-referrals, violations of this Agreement, suspicious activity, duplicate transactions, or any conduct intended to improperly generate affiliate commissions. Any withheld commissions may be reviewed before payment is authorized.
